Terms of Service

Effective date: July 29, 2026

These Terms of Service ("Terms") form a binding agreement between you and Smart Study Lab ("Smart Study Lab," "we," "us," or "our") governing your access to and use of our website, applications, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you represent that you have obtained permission from a parent or legal guardian to use the Service and that they have reviewed and agree to these Terms on your behalf. By using the Service, you represent that you meet these requirements and that all registration information you submit is accurate and truthful.

2. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must notify us promptly at the contact address in Section 15 if you suspect unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are inactive for an extended period, subject to applicable law.

3. Description of Service

Smart Study Lab allows users to upload study materials and generate AI-assisted flashcards, quizzes, study guides, and related content, and to track study progress over time. Certain features may rely on third-party AI models and services; outputs are generated automatically and may contain errors, omissions, or inaccuracies (see Section 6, "AI-Generated Content").

4. Acceptable Use

You agree not to use the Service to:

  • Upload content that is unlawful, infringing, defamatory, obscene, or that violates the rights of any third party, including intellectual property or privacy rights;
  • Upload malware, or attempt to gain unauthorized access to the Service, other accounts, or our systems and networks;
  • Reverse engineer, decompile, scrape, or attempt to extract the source code or underlying models of the Service, except as permitted by applicable law;
  • Use the Service to generate content that harasses, threatens, or discriminates against any individual or group;
  • Interfere with or disrupt the integrity or performance of the Service, including through automated means not authorized by us;
  • Use the Service for any commercial purpose not expressly permitted by us, or in a way that violates any applicable law or regulation.

We reserve the right, but have no obligation, to review, remove, or restrict access to any content or account that we reasonably believe violates these Terms.

5. Your Content

You retain all ownership rights to the materials you upload to the Service ("User Content"). By uploading User Content, you grant Smart Study Lab a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display your User Content solely as necessary to operate, provide, and improve the Service for you (including transmitting it to third-party AI providers to generate the outputs you request). This license ends when you delete the applicable content or your account, except to the extent copies are retained as required by law or for routine backup purposes for a limited period.

You are solely responsible for the User Content you upload and represent that you have all necessary rights to upload it and to grant the license above.

6. AI-Generated Content

Flashcards, quizzes, study guides, summaries, and other materials generated by the Service are produced using artificial intelligence and may contain factual errors, omissions, or inaccuracies. AI-generated content is provided for study and educational assistance purposes only and should not be relied upon as a sole source of truth for academic submissions, professional decisions, or any purpose where accuracy is critical. You are responsible for independently verifying any AI-generated content before relying on it, and for complying with your institution's academic integrity policies regarding the use of AI tools.

7. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content we provide (excluding your User Content), is owned by Smart Study Lab or its licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you in our intellectual property.

8. Third-Party Services

The Service integrates with third-party providers, including authentication (e.g., Google Sign-In via Supabase), hosting and database infrastructure (e.g., Supabase, Vercel), and AI processing (e.g., Google Gemini API). Your use of these integrations may also be subject to the applicable third party's terms and privacy policies. We are not responsible for the acts, omissions, or availability of third-party services.

9. Subscription and Payment (If Applicable)

If we offer paid plans, additional terms regarding billing, renewal, and cancellation will be presented to you at the time of purchase and are incorporated into these Terms by reference. Unless stated otherwise at checkout, fees are non-refundable except as required by applicable law.

10. Termination

You may stop using the Service and delete your account at any time through your account settings or by contacting us. We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms, though we will make reasonable efforts to notify you where required by law. Upon termination, your right to use the Service ceases immediately; provisions of these Terms that by their nature should survive termination (including Sections 6, 7, 11, 12, 13, and 14) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. YOU USE THE SERVICE AT YOUR OWN RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMART STUDY LAB AND ITS OWNERS, AFFILIATES, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to indemnify, defend, and hold harmless Smart Study Lab and its owners, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your User Content; (b) your use or misuse of the Service; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

14. Dispute Resolution and Governing Law

These Terms are governed by the laws of the United States and the state in which Smart Study Lab operates, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law. Before initiating a formal legal proceeding, you agree to first contact us at the address in Section 15 and attempt in good faith to resolve the dispute informally. Any dispute that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts located in that state, and you consent to personal jurisdiction there, except where applicable law provides otherwise (for example, certain consumer-protection laws may entitle you to bring a claim in your local jurisdiction, and nothing in these Terms limits rights that cannot be waived under applicable law).

15. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will update the "Effective date" above and provide reasonable notice (such as an in-app notice or email) before the changes take effect. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

16. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Study Lab regarding the Service.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
